EXPLANATORY MEMORANDUM

1. The Government of the Federal Republic of Germany has informed the Commission of its intention to negotiate and conclude with the Republic of Austria an Agreement on the management of the water of the Danube basin. The negotiations will take place during August 1980 on the basis of a draft Agreement which includes provisions on the protection of the water of the Danube against pollution.

2. The Council has already adopted several acts intended to protect river water and some of these are affected by the Agreement referred to above. These are, inter alia,

- the Directive 75/440/EEC of 16 June 1975 concernant the quality required of surface water intended for the abstraction of drinking water in the Member States,

- the Directive 76/160/EEC of 8 December 1975 concerning the quality of bathing water,

- the Directive 76/464/EEC of 4 May 1976 on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community,

- Directive 78/659/EEC of 18 July 1978 on the quality of fresh waters needing protection or'improvement in order to support fish life.

For the same reasons the Community became a party to the Convention for the prevention of marine pollution from land based sources, to the Convention for the protection of the Rhine against chemical pollution and to the Additional Agreement to the Agreement, signed in Berne on 29.4.1963, concerning the International Commission for the protection of the Rhine against pollution.

3. In view of the competence of the Community in part of the area covered by the draft Agreement, it is necessary for the Community to become a

. Contracting Party to that Agreement.

4. In conclusion the Commission recommends that the Council authorise the Commission to negotiate the Agreement on the management of the water of the Danube basin and, to that end, to adopt the annexed Decision.

Recommendation for a COUNCIL DECISION

authorizing the Commission to participate in the negotiation of an agreement on cooperation in

the management of the water of the Danube basin

THE COUNCIL OF THE EUROPEAN COMMUNITIES

Having regard to the Treaty establishing the European Economic Community,

Having regard to the Recommendation from the Commission,

Whereas negotiations, in which the Federal Republic of Germany and the Republic of Austria will take part, will take place in August 1980 with a view to the conclusion of an agreement on cooperation in the management of the water of the Danube basin.

Whereas the Council has adopted several directives concerning the management of water, and. in particular    . Directive 76/464/EEC of 4 May

1976 on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community. ;

Whereas, in view of the Community competence in the sphere concerned, it ' is essential that the Community participate in the negotiation of the above-mentioned agreement,

HAS DECIDED AS FOLLOWS:

Sole Article

The Commission is hereby authorised to participate in the negotiation of an agreement on cooperation in the management of the water of the Danube basin.

The Commission shal l conduct such negotiations in accordance with the annexed directive.
