Legal provisions of COM(2015)446 - Conclusion of the Agreement with Morocco concerning protection of geographical indications and designations of origin for agricultural products, fish and fishery products

Article 1

1. The Agreement in the form of an exchange of letters between the European Union and the Kingdom of Morocco concerning protection of geographical indications and designations of origin for agricultural products, processed agricultural products, fish and fishery products and amending the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Kingdom of Morocco, of the other part and the Joint Declaration thereto are hereby approved on behalf of the Union.

2. The text of the Agreement is annexed to this Decision.

Article 2

1. The Commission shall represent the Union in the Joint Committee referred to in Article 14 of the Agreement.

2. Amendments to the Agreement made by decision of the Joint Committee as referred to in Article 14 of the Agreement shall be approved by the Commission on behalf of the Union.

3. If no agreement is reached between the Parties in an objection procedure concerning the addition of a geographical indication, the Commission shall adopt its position on the basis of the procedure laid down in Article 5 of Regulation (EU) No 182/2011 of the European Parliament and of the Council 2 . The Commission shall be assisted by the Committee on Agricultural Product Quality Policy established by Regulation (EU) No 1151/2012 of the European Parliament and of the Council 3 , by the Committee for the Common Organisation of Agricultural Markets established by Regulation (EU) No 1308/2013 of the European Parliament and of the Council 4 , or by the Committee for Spirit Drinks established by Regulation (EC) No 110/2008 of the European Parliament and of the Council 5 .

Article 3

The President of the Council shall designate the person empowered, on behalf of the Union, to deposit the instrument of acceptance provided for in the Agreement, in order to express the consent of the European Union to be bound by the Agreement.

Article 4

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.
