Legal provisions of COM(2016)277 - Amendment of the regulation listing third countries whose nationals require visa and those whose nationals are exempt from that requirement (Kosovo)

Article 1 Regulation (EC) No 539/2001 is amended as follows:

(a)     in Annex I, Part 2 ("ENTITIES AND TERRITORIAL AUTHORITIES THAT ARE NOT RECOGNISED AS STATES BY AT LEAST ONE MEMBER STATE"), the reference to Kosovo as defined by the United Nations Security Council Resolution 1244 of 10 June 1999 is deleted.

(b)     in Annex II, Part 4 ("ENTITIES AND TERRITORIAL AUTHORITIES THAT ARE NOT RECOGNISED AS STATES BY AT LEAST ONE MEMBER STATE "), the following reference is inserted:

“Kosovo* (**)”


* This designation is without prejudice to positions on status, and is in line with

UNSCR 1244/1999 and the ICJ Opinion on the Kosovo declaration of independence

**     The exemption from the visa requirement is limited to the holders of biometric

passports issued in line with Council Regulation (EC) No 2252/2004 of 13 December 2004 on standards for security features and biometrics in passports and travel documents issued by Member States, OJ L 385, 29.12.2004, p. 1.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in the Member States in accordance with the Treaties.
