on the exercise of the power to adopt delegated acts conferred on the Commission under Regulation (EU) 2017/1004 concerning
Union framework for the collection, management and use of data in the fisheries sector
1.Background
Regulation (EU) 2017/1004 of the European Parliament and the Council on the establishment of a Union framework for the collection, management and use of data in the fisheries sector and support for scientific advice regarding the common fisheries policy confers on the Commission the power to adopt delegated acts 1 . Under Article 4 of this Regulation the Commission shall adopt a multiannual programme for the collection and management of data of biological, environmental, technical and socioeconomic data in the fisheries and aquaculture sectors (EU MAP). Article 4(1) empowers the Commission to adopt the detailed list of data requirements to achieve the objectives set out in Articles 2 and 25 of Regulation (EU) No 1380/2013 on the common fisheries policy 2 that forms part of this EU MAP by delegated act.
The power to adopt delegated acts is conferred for a period of 3 years from 10 July 2017. This power is tacitly extended for periods of 3 years unless the European Parliament or the Council object. According to Article 24(2) the Commission shall draw up a report in respect of the delegation of power 3 . This report fulfils this obligation.
2.Commission exercise of delegated powers under Regulation (EU) 2017/1004
The 2017-2019 EU MAP 4 expired on 31 December 2019. The Commission used its delegated power to adopt Commission Delegated Decision (EU) 2019/910 5 of 13 March 2019 establishing the multiannual Union programme for the collection and management of biological, environmental, technical and socioeconomic data in the fisheries and aquaculture sectors. The Commission Delegated Decision renews the corresponding provisions and rules of Commission Implementing Decision (EU) 2016/1251 for 2020-2021, without changing the substance of the provisions.
Commission Delegated Decision (EU) 2019/910 was adopted to establish the EU MAP for 2020-2021. For the purpose of the EU MAP this Decision has to be considered in conjunction with Commission Implementing Decision (EU) 2019/909 6 , adopted on 18 February 2019 and also applicable for 2020-2021.
3.Conclusion
The Commission has exercised its delegated powers upon the expiry of Commission Implementing Decision (EU) 2016/1251 in 2019. Commission Delegated Decision (EU) 2019/910 ensures the framework, provisions and rules establishing a multiannual Union programme for the collection and management of biological, environmental, technical and socioeconomic data in the fisheries and aquaculture sectors for 2020-2021, thus ensuring the implementation of Regulation (EU) 2017/1004 for this period. The Commission sees the need to extend the empowerment to adopt consequent delegated acts establishing multiannual Union programmes beyond 2021.
