REPORT FROM THE COMMISSION TO THE EUROPEAN PARLIAMENT AND THE COUNCIL

on the exercise of the power to adopt delegated acts conferred on the Commission under Regulation (EU) 2017/1004 concerning

Union framework for the collection, management and use of data in the fisheries sector


1.Background

Regulation (EU) 2017/1004 of the European Parliament and of the Council on the establishment of a Union framework for the collection, management and use of data in the fisheries sector and support for scientific advice regarding the common fisheries policy confers on the Commission the power to adopt delegated acts 1 . Under Article 4 of this Regulation, the Commission is required to adopt a multiannual programme for the collection and management of biological, environmental, technical and socio-economic data in the fisheries and aquaculture sectors. Article 4(1) empowers the Commission to adopt by delegated act the detailed list of data requirements to achieve the objectives set out in Articles 2 and 25 of Regulation (EU) No 1380/2013 on the common fisheries policy 2 , which forms part of the multiannual programme.

The power to adopt delegated acts is conferred for a period of 3 years from 10 July 2017. This power is tacitly extended for periods of 3 years unless the European Parliament or the Council object. In accordance with Article 24(2), the Commission is required to draw up a report in respect of the delegation of power 3 . This report fulfils this obligation.

2.Commission exercise of delegated powers under Regulation (EU) 2017/1004

The 2020-2021 multiannual programme 4  expired on 31 December 2021. The Commission used its delegated power to adopt Commission Delegated Decision (EU) 2021/1167 5 of 27 April 2021 establishing the multiannual Union programme for the collection and management of biological, environmental, technical and socio-economic data in the fisheries and aquaculture sectors from 2022. The Commission Delegated Decision revises the corresponding provisions and rules of Commission Delegated Decision (EU) 2019/910. For the purpose of the multiannual programme, this Decision has to be considered in conjunction with Commission Implementing Decision (EU) 2021/1168 6 , adopted on 27 April 2021.

3.Conclusion

The Commission has exercised its delegated powers upon the expiry of Commission Delegated Decision (EU) 2019/910 in 2021. Commission Delegated Decision (EU) 2021/1167 establishes the multiannual Union programme for the collection and management of biological, environmental, technical and socio-economic data in the fisheries and aquaculture sectors from 2022, thus ensuring the implementation of Regulation (EU) 2017/1004. Although the multiannual programme does not contain an end date, it will have to be revised in a foreseeable future, to accommodate emerging needs for data, and to adapt its scope to changing fisheries profiles andpolicy requirements. The Commission sees the need to extend the duration of the empowerment to adopt subsequent delegated acts establishing multiannual Union programmes.
