COUNCIL DIRECTIVE

on statistical returns in respect of carriage of goods by rail, as

part of regional statistics

(submitted to the Council by the Commission)

' v Explanatory Memorandum . .

1. In the framework of the common transport policy and of regional policy, the

Commission needs "basic information on the transport of goods by the various modes of transport. v

2. Whereas important progress has been made in relation to the carriage of goods by road with the Council Directive of 12 June 1978 (78/546/EEC) the existing information available for rail is insufficiently harmonised to be used at Community level for policy purposes.

3. The proposal therefore provides for the collection of statistical informa— tion on international, national and regional traffic flows, to complement the supply of information in respect of transport of goods by road. Some

of the more basic information will be provided on a monthly basis, in order to facilitate the operation of a system of Market Observation by DG VII.

4. In addition, information is required on container traffic and rail/road traffic in view of the present growth and future importance of combined transport.

THE COUNCIL OP THE EUROPEAN COMMUNITIES

Having regard to t;he Treaty establishing the European Economic Community, and in particular Article 213 thereof,

Having regard to the draft Directive submitted by the Commission,

Having regard to the opinion of the European Parliament (l),

Having regard to the opinion of the Economic and Social Committee ,

Whereas, in order to carry out the tasks entrusted to it under the Treaty, the Commission must have at its disposal coherent, synchronised and regular statistical data on the scale and development of the carriage of goods by rail in the Member States; whereas these data must be comparable both as between States and also with the data for other modes of transport and must refer to national, international and transit traffic;

Whereas, in view of the economic and environmental advantages of combined rail/road transport, the statistical data should distinguish separately^, such traffic;

Whereas, in order to permit adequate observation of the market for the carriage of goods by rail, such statistical data should distinguish separately traffic

on the main traffic relations;

Whereas, in view of the limited significance on the Community transport mar— ket, Member States with railway networks other than the main network , should provide only simplified statistical data in respect of such other networks;

Whereas the statistics already available in the different Member States on goods traffic should be further harmonised at Community level, in order to serve as a valid basis for the work of the Commission;

Whereas, in order to facilitate the implementation of the proposed provisions, certain time' limits should be laid down for providing the necessary statisti—. cal information; ■ ,

Whereas the Commission must submit a report, in order to enable the Couficil • . • . 1 to examine the extent to which the statistical data submitted can help achieve

the objectives of this Directive; whereas, it must envisage the possibility of

proposing amendments to the methods used, where appropriate, and also of pro—

Whereas statistical data are essential for knowledge of the scale and development of transport; whereas the Community considers it appropriate to make, for an initial period, a financial contribution in respect of the work involved; . '

HAS ADOPTED THIS DIRECTIVE : ■ - '

' • Article 1 . ,

1. Member States shall ca!rry out statistical surveys of the carriage of goods on the railway networks in their territory open to public traffic.

2. For the purpose of this Directive, the following terms shall have the

meanings hereinafter assigned to them : , ’ . .

a) railway : a mode of transport using rails as a track; ~ \

b) railway network : all railway lines and installations operated by a

railway administration; .

c) main networks : networks operated by the following; administrations :

d) other networks : networks,- other than the main networks, which arc open to public traffic and connected to a main network by common installations, excluding railways solely or primarily serving a single urban area, e.g. tramways,

e) carriage of goods : the movement of goods using railway vehicles between the place of loading and the place of unloading, whether or not such vehicles covered part of the distance by other means of transport,

3. This Directive shall not apply to the carriage of goods:

— as service traffic for non—commercial purposes,

— as passenger accompanied luggage or cars,

— as mail oh behalf of postal administrations,

— by a subsidiary or associated company, on another mode- of transport,

4, The first surveys shall be carried out with effect from

Article 2

1, The following particulars shall be recorded in respect of goods carried on the main networks :

a) the weight of the goods in tonnes;

b) the main traffic relations, i,e, :

— national traffic, where the goods are both loaded and unloaded within the same reporting Member State, irrespective of the route followedj

-4" — international traffic, where the goods are either loaded or unloaded,

hut not Doth, in the reporting Member State, distinguishing between goods loaded and unloaded; -

— transit traffic, where the goods pass through, without being loaded, unl.oaded or transhipped in the reporting Member State;

c) the type of consignment : .

— full wagon load : consignment of goods, including bulk consignment of smalls, for which the exclusive use of a wagon is charged, whether or not the load capacity is fully used; including full train loads;

— smalls : other consignments of goods, including express and other parcels;

d) in' respect of full wagon loads :

— the nature of goods according to the groups of goods shown in column 2 of Annex I; .

— for national traffic the national regions of loading and unloading,

as listed in Annex II; . '

— the countries of loading and unloading, subdivided into international traffic and transit as listed in Annex III;

e) the distance in kilometres. .

2. The following particulars shall be recorded in addition, in respect of

combined transport on the main network : >

a) large containers, 6.1 metres (20 feet) or more in external length :

— the gross weight of goods carried, excluding the tare weight of the

. container (estimated, if necessary); . -

— the number of containers empty and loaded (in actual numbers and

twenty foot equivalent units); ^

b) rail/road goods : lorries, trailers, semi-trailers (with or without

tractor-unit) and swop bodies :

— the number of railway wagons loaded, , .

— the gross weight of goods transported, including road vehicles, .

— the distance in km. . ‘ -

In respect of goods carried on the 'other networks', the following particulars shall be recorded :

a) the weight of the goods In tonnes; ■

b) the type of consignment (as defined in Article 2 paragraph 1c)):

— full wagon loads,

— smalls;

c) the distance on such 'other networks' in kilometres;

d) the nature of the goods according to the groups of goods shown in column 1 of Annex I, in respect of full wagon loads.

Article 3

1. With the exception of information subject to statistical secrecy under national laws, the results of the surveys shall be notified

to the Commission as soon as possible but not later than three months after the end of the reference periods involved.

2, The results in respect of the particulars referred to in Article 2 paragraphs 1 and 2 shall be submitted in accordance with the models of the annual or monthly tables set out in Annex IV.

31 The results in respect of the particulars referred to in Article 2 para— graph 3 shall be submitted in accordance with the models of the annual table set out in Annex V.

4. Survey results which are processed electronically may be submitted in a machine—readable form of a type and format to be determined by the Commission in consultation with the Member States concerned1

2. The Commission, in collaboration with the Member States, shall -

examine the methodological and technical problems raised by the surveys, in order to find solutions which make the data as coherent and comparable as possible. ■

1. The Commission shall publish appropriate results of the surveys. •

2. Before 1 January 1983, "the Commission shall submit to the Council a report on the experience acquired in the work carried out pursuant to this Directive, and shall propose any amendments necessary*

3* The Commission shall also submit to the Council proposals to introduce regional statistics in respect of international traffic and statistics of full train loads*

Article 6

For the first three years in which the statistical surveys provided for in

this Directive are made, a financial contribution towards the expenditure . incurred by the Member States shall be granted within the limit -of the appropriations set aside for this purpose under the budget of the European Communities. '

The Member States shall take the measures necessary to comply with this Directive not later than 1st January 1981* .... . .

2. Legal "basis : Article 213 of the Treaty. This Directive is intended to complete the statistical information envisaged "by directive 78/546/EEC of the Council on statistical returns in respect of carriage of goods by road as part of regional statistics.

3. Description of the projeot : ,

a) objectives : the collection of synchronised and regular statistics on the carriage of goods by rail in the Member States;

b) persons concerned : the national governmental and railway administrations . in the Member States will be responsible for the collection of the sta—

tistics.

c) , other details : a Council Directive on statistical returns in respect of

the carriage of goods by road was approved in June 1978 (78/546/EEC); a draft Council Directive on statistical returns in respect of carriage of goods by inland waterway is being proposed at this time.

4. Justification of project : the further harmonisation at Community level of

statistics of rail goods traffic, both national and international, on a quarterly and annual basis, is essential for the development of a common transport policy and can only be achieved by means of a directive. .

5.3.2 Method of calculation : approximately 33% for the inital pro— graroming costs in 1980; and the remainder to be shared in ' proportion to the number of documents to be processed in respect of the movement- of loaded railway wagons.

6. Financial implications on appropriations for staff and routine administration - NIL. ‘ x

7. Financing from intervention expenditure : .

7.1 Current budget : partial reallocation of budget : since 1962 yearly finance has been‘provided for 6 Member States to conduct annual surveys of : , .

(i) NST statistics of goods transport by inland waterway, rail and

road (21 550 EUA in 1979) and .

(ii) regional statistics (93 170 EUA. in 1979).

These annual payments can be terminated and the funds otherwise required on a continuing basis can be transferred to provide the financial contributions for 1980, 1981 and 1982, when this proposal (together with the proposal for inland waterway statistics) is accepted.

1. The Member States shall submit to the Commission/a detailed description of the methods to be us$d for the surveys in compiling the. data and in calculating figures for tonne-kilometres.
