Explanatory Memorandum to COM(1999)472 - Amendment of Regulation (EC) No 54/1999 allocating, for 1999, Community catch quotas in Greenland waters

Pursuant to Article 1 paragraph 2 of the Third Protocol  i, the Community is entitled to 70% of the Greenland share of the capelin. This provision has to be seen against the background that the capelin stock in the waters off Eastern Greenland is managed jointly by Greenland, Iceland and Norway. This year's tripartite consultations have led to an agreement, by way of which the relevant TAC was set at 1,285,000 tonnes for 1999. Under the Third Protocol, the ensuing Community catch quota in Greenland waters will be 98,945 tonnes and, after deduction of the quantities granted to the Faroe Islands, Iceland and Norway, the net quota available to Member States will be 48,945 tonnes.

Council Regulation (EC) No 54/1999  i established the corresponding Community catch quota at 109,340 tonnes on the basis of a TAC of 1,420,000.

The objective of this proposal is to implement the measures resulting from the variation of the underlying TAC.

COUNCIL REGULATION

amending Regulation (EC) No 54/1999 allocating, for 1999, Community catch quotas in Greenland waters

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 3760/92 of 20 December 1992 establishing a Community system for fisheries and aquaculture  i and in particular Article 8 i thereof,

Having regard to the proposal from the Commission,

Whereas

Council Regulation (EC) No 54/1999  i established, for 1999, the Community catch quota for capelin in Greenland waters on the basis of the TAC for 1998/99;

a revision of the relevant TAC in the meantime has resulted in a change in the share available to the Community;

Regulation (EC) No 54/1999 has to be amended accordingly;

HAS ADOPTED THIS REGULATION

Article 1

In Annex I to Regulation (EC) No 54/1999, the entry referring to capelin is amended as set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
