The Government of the Federal Republic of Germany has informed the Commission of its intention to negotiate and conclude with the Republic of Austria an Agreement on the management of the water of the Danube basin. The negotiations will take place during August 1980 on the basis of a draft Agreement which includes provisions on the protection of the water of the Danube against pollution.

2. The Council has already adopted several acts intended to protect river water and some of these are affected by the Agreement referred to above. These are, inter alia,

- Directive 78/659/EEC of 18 July 1978 on the quality of fresh waters needing protection or'improvement in order to support fish life.

For the same reasons the Community became a party to the Convention for the prevention of marine pollution from land based sources, to the Convention for the protection of the Rhine against chemical pollution and to the Additional Agreement to the Agreement, signed in Berne on 29.4.1963, concerning the International Commission for the protection of the Rhine against pollution.

3. In view of the competence of the Community in part of the area covered by the draft Agreement, it is necessary for the Community to become a

. Contracting Party to that Agreement.

4. In conclusion the Commission recommends that the Council authorise the Commission to negotiate the Agreement on the management of the water of the Danube basin and, to that end, to adopt the annexed Decision.
