explanatory memorandum

Council Regulation (EEC) n° 848/81 fixing certain measures for the conservation and management of fishery resources applicable to • vessels flying the flag of certain non-member countries in the :

200 nautical mile zone off the coast of the' French department of Guyana expires on 31 March 1982.    '

A proposal for a Regulation fixing these measures for the period 1 April 1982 to 31 March 1983 has been submitted by the Commission to the Council. As this proposal cannot be adopted in time by the Council, because of the need to consult the European Parliament, it is necessary to extend the period of validity of licenses granted according to Regulation .(EEC) n° 848/81 to avoid an interruption in the supply of the processing industry of the department of French Guyana, which is ensured exclusively by the catches of vessels flying the flag of non-member countries holding fishing licenses, which are obliged by contract to land all their catches in that department.

THE COUNCIL OF THE EUROPEAN COMMUNITIES,    i

Having regard to the Treaty establishing the European Economic

Community, and in particular article 103 thereof,    K

Having regard to the proposal from the Commission,

Whereas .the Community has established a system of conservation    '

and management of fishery resources applicable to vessels flying the flag of certain non-member countries in the 200 mile zone off the coast of the French department of Guyana, most recently laid down by Council Regulation (EEC) n° 848/81 (1); whereas the latter expires on 31 March 1982;

Whereas the Regulation fixing this system for the period beginning 1 April 1982 cannot be adopted before that date; whereas, to avoid any interruption of supplies to the processing industry of the French department of Guyana, which is exclusively ensured by ships flying the flag of non-member countries which are obliged by contract to land all their catches in that department, it is necessary to extend the period of validity of fishing licences granted pursuant to Regulation (EEC) n° 848/81,by forty-five days.

HAS ADOPTED THIS REGULATION :

Article 1

Fishing licences valid on 31 March 1982 under Regulation (EEC) n° 848/81 shall remain valid until 15 May 1982 under the conditions laid down by the said Regulation.

Article 2

This Regulation shall enter into force on 1 April 1982.

This Regulation shall be binding in its entirety and directly applicable in all member States.
