The Commission is currently engaged in consultations with Norway. Pending their completion and in order to take account immediately of the interests of Community fishermen, the Commission proposes interim and strictly limited quotas for the period beginning 1 June 1983 on a non-disc riminatory basis and utilising an ad-hoc allocation key which does not prejudice in any manner the future key which will be proposed by the Commission for the allocation of TACs for herring in these stocks or all other stocks.
After the end of the consultations with Norway, the Commission will examine the TACs and quotas for herring in order to lay its proposals before the Council in good time. In the exceptional case of the Netherlands, the Commission proposes that the fishery may commence on the 28 May 1983 so as to respect historical traditions.
The quotas proposed for member States which have traditional fishing in zones IVa and IVb are very significantly less than the shares of the stocks to which the Community would be entitled in these zones, bearing in mind the TACs recommended by ACFM and the interest of third countries, in particular Norway, in the matter.
As soon as the consultations with Norway have been finalised a complete proposal for all herring stocks will be made.

THE COUNCIL OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Economic Community,
Having regard to Council Regulation (EEC) No. 170/83 of 25 January 1983 establishing a Community system for the conservation and management of fishery resources (1), and in particular articles 2, 3, 4 paragraph 1 and 11 thereof.
Having regard to the proposal from the Commission,
Whereas fishing activities on the northern and central North Sea herring stocks are prohibited according to Council Regulation (EEC) No. 198/83 of 25 January 1983 (2) in connection with Council Regulation (EEC) No. 172/83 of the same date (3), until such time as the Council takes a decision on the Commission's proposals concerning TACs and quotas applicable in 1983;
Whereas fishing for the northern and central North Sea herring stocks may be authorized for a limited quantity following the scientific advice;
Whereas pending the results of current consultations with Norway'-'and a final Council decision it is appropriate to authorize Community fishermen to commence fishing on the northern and central North Sea herring stocks from 1 June 1983;

Whereas in the case of the Netherlands fishermen, historical traditi-on justifies that fishing may start on 28 May 1983;
Whereas it is not necessary to allocate these preliminary allocations between ICES divisions .IVa and IVb;
Whereas it is necessary to control the uptake of the catches allowed, catches shall be reported daily by ICES division. .

Article 1
By derogation from Article 1 of Council Regulation (EEC) n° 198/83 (1) fishing for herring shall be authorized in the northern and central North Sea (ICES divisions IVa and IVb) according to Annex from 1 June 1983 except in the case of Netherlands fishermen who are authorized to begin fishing on 28 May 1983.
Article 2
Member States shall report daily by telex to the Commission catches of herring by their vessels.
Article 3
Catches made under Article 1 shall count against the total allowable catch, the share available to the Com'unity and the allocations to each Member State finally fixed in^the Regulation fixing for certain fish stocks and groups of fish stocks occurring in the Community's fishing zone, total allowable catches for 1983, the share of these catches available to the Community, the allocation of that share between the member States and the .conditions under which the total allowable catches may be fished.
Article 4
This Regulation shall enter into force on the day of its publication in the official journal of the European Communities. It shall apply from 28 May 1983.
This Regulation shall be binding in its entirety an directly applicable in all member States.

(1) Fishing for herring in the whole of ICES Division IVb is prohibited from 15 August 1983 to 30 September 1983 and east of 3°e.throughout the year.
