The organisation of elections in the EU is largely regulated at Member State level, and there are a variety of national laws affecting political advertising and communications, including on their transparency. There is also a significant body of EU law relevant in this context. This includes in the context of European parliamentary elections, the 1976 European Electoral Act and the regulation on the statute and financing of European Political Parties and Foundations. The Commission does not have a general power to intervene in electoral matters. Subject to the respect of certain basic principles, such as those laid down in Articles 2 and 14 of the Treaty on European Union, it is the competence and the responsibility of the Member States to lay down the specific conditions for the conduct of elections, and of the competent national administrative and judicial authorities to ensure compliance with applicable law and relevant standards.
