Annex I to Regulation (EC) No 1217/2009.

Council Regulation (EC) No 1217/2009 empowers the Commission to adopt delegated Regulations laying down the rules related to the data for the determination of incomes and the business analysis of agricultural holdings, with the aim of ensuring a harmonized framework for the information to be reported by Member States.

As provided by Article 3, Articles 5(1) and 5a(1), Article 5b(2) and (3) and Article 8(3) of that Regulation the delegated act should notably establish rules:

- for updating the list of FADN divisions,

- for fixing the threshold values delimiting the field of survey,

- for establishing plans for the selection of returning holdings,

- for fixing the reference period for the standard outputs, and for determining the general and principal types of farming, and

- for determining the main groups of accountancy data on farm returns to be collected as well as the general rules to be followed in this respect.


1. Delegation of powers laid down in Article 3 of Regulation (EC) No 1217/2009 on the list of FADN divisions per Member State

The FADN divisions, as defined by Article 2 of the Council Regulation (EC) No 1217/2009, are the territories of a Member State, or any part thereof as delimited with a view to the selection of returning holdings. A list of such divisions is laid down in Annex I of that Regulation.

Article 3 of Council Regulation (EC) No 1217/2009 ensures that the list of FADN divisions may be updated following a request by a Member State and empowers the Commission to adopt delegated acts, in accordance with Article 19a of the mentioned Regulation, to amend the list in Annex I.

In 2022, France requested to merge the FADN divisions Guadeloupe and Martinique into one FADN division: Antilles françaises. In addition, following the withdrawal of the United Kingdom from the Union, FADN data are no longer collected in that country as of the 2021 accounting year.

The Commission adopted Delegated Regulation (EU) 2022/2497 (4) amending Annex I with respect to the list of FADN divisions per Member State, by merging the French divisions Guadeloupe and Martinique into one uniform FADN division, called Antilles françaises, and by removing the United Kingdom from the list of FADN divisions.

In Annex I, the list of FADN divisions concerning France was replaced by the following:

The Commission adopted Delegated Regulation (EU) 2022/2497 on 12 October 2022 and it entered into force on the third day following that of its publication in the Official Journal of the European Union, on 23 December 2022. It applied from the accounting year 2023 for the Farm Accountancy Data Network.


2. Delegation of powers laid down in Article 5 of Regulation (EC) No 1217/2009 on the rules for fixing the threshold for the economic size

Delegated Regulation (EU) No 1198/2014 (5) provides for rules for fixing the threshold for the economic class. No amendment to this delegated act took place over the period from 2018 until 2022.


3. Delegation of powers laid down in Article 5a of Regulation (EC) No 1217/2009 on the rules to draw up a plan for the selection of returning holdings for each Member State

Delegated Regulation (EU) No 1198/2014 (6) provides for rules for drawing the selection plan for each Member State. No amendment to this delegated act took place over the period from 2018 until 2022.



4. Delegation of powers laid down in Article 5b of Regulation (EC) No 1217/2009 fixing the reference period for the standard output and concerning the determination of the general and principal types of farming

Delegated Regulation (EU) No 1198/2014 (7) provides for rules regarding the reference period for the standard output. No amendment to this delegated act took place over the period from 2018 until 2022.


5. Delegation of powers laid down in Article 8 of Regulation (EC) No 1217/2009 concerning the determination of the main groups of accountancy data to be collected and the general rules for data collection

Delegated Regulation (EU) No 1198/2014 (8) sets main groups of accountancy data to be collected in the farm return. No amendment to this delegated act took place over the period from 2018 until 2022.

4. CONCLUSION

The Commission has exercised its delegated powers in the period from 2018 until 2022 correctly and invites the European Parliament and the Council to take note of this report.
