COUNCIL DECISION of 19 December 1994 on the joint action adopted by the Council on the basis of Article J.3 of the Treaty on European Union concerning the control of exports of dual-use goods (94/942/CFSP)
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article J.3 thereof,
Having regard to the general guidelines given by the European Council on 26 and 27 June 1992,
HAS DECIDED AS FOLLOWS:
Article 1
A joint action, aimed at protecting Member State's essential security interests and meeting their international commitments, on the control of exports from the Community of goods which can be used for both civil and military purposes, hereinafter referred to as 'dual-use goods`, is hereby adopted.
This Decision and Council Regulation (EC) No 3381/94 of 19 December 1994 setting up a Community regime for the control of exports of dual-use goods (1), constitute an integrated system involving, in accordance with their own powers, the Council, the Commission and the Member States.
Article 2
The list of dual-use goods shall be as set out in Annex I. That list shall apply for the purposes of Article 3 (1) and Article 19 (1) (a) and (2) of Regulation (EC) No 3381/94.
Article 3
The list of destinations to which Article 6 (1) (a) of Regulation (EC) No 3381/94 applies shall be as set out in Annex II.
Article 4
The guidelines to be taken into consideration for the purpose of Article 8 of Regulation (EC) No 3381/94 shall be as set out in Annex III.
Article 5
The list of goods to which Article 19 (1) (b) of Regulation (EC) No 3381/94 applies shall be as set out in Annex IV.
Article 6
The list of goods and Member States to which Article 20 (1) of Regulation (EC) No 3381/94 applies shall be as set out in Annex V.
Article 7
This Decision shall be published in the Official Journal of the European Communities on the same day as Regulation (EC) No 3381/94.
Any subsequent amendments to this Decision shall also be published in the Official Journal of the European Communities.
Article 8
This Decision shall enter into force on the day of its publication.
It shall apply from 1 March 1995.

ANNEX I
List referred to in Article 2 of the Decision and Article 3(1) of Regulation (EC) No 3381/94 (Common list of dual-use goods which are subject to control when exported from the European Community)
LIST OF DUAL-USE GOODS This list implements internationally agreed dual-use controls including the Community strategic controls, MTCR, NSG and Australia Group. No account has been taken of any items that Member States wish to place on an exclusion list. No account has been taken of any national controls (non-regime origin controls) that may be maintained by Member States.

1.For control of goods which are designed or modified for military use, see the relevant list(s) of controls on military goods maintained by individual Member States. References in this Annex that state 'SEE ALSO MILITARY GOODS CONTROLS` refer to the same lists.

2.The object of the controls contained in this Annex should not be defeated by the export of any non-controlled goods (including plant) containing one or more controlled components when the controlled component or components are the principal element of the goods and can feasibly be removed or used for other purposes.
