L 43 vom 15.2.1983, S. 1), geandert durch die Verordnung (EG, Euratom) Nr. 1700/2003 vom 22. September 2003 (ABI. L 243 vom 27.9.2003, S. 1), ist diese Datei der Offentlichkeit zuganglich. COMMUNICATION FROM THE COMMISSION TO THE COUNCIL CONCLUSION BY THE COMMUNITY OF THE COUNCIL OF EUROPE'S CONVENTION ON THE CONSERVATION OF EUROPEAN WILDLIFE AND NATURAL HABITATS'

Communication from the Commission to the Council

Subject : Conclusion by the Community of the Council of Europe's Convention on the Conservation of European Wildlife and Natural Habitats.

On 27 March 1979, the Commission sent to the Council a recommendation for a Council Decision authorizing the Commission to participate in the negotiations to conclude the Convention cited above (COM (79) 146 final). This document sets out the reasons why the Community as such should sign and conclude this Convention alongside its Member States.

In the meantime, the Secretariat of the Council of Europe has informed the Commission that the Committee of Ministers, the executive body of that organization, has adopted the following decisions : "The Deputies :

i. adopted the text of the European Convention on the Conservation of European Wildlife and Natural Habitats as it appears at Appendix ... to the Conclusions; (Annex I) (1)

ii. decided to open the Convention for signature by Member States

on 17 September 1979 in Berne on the occasion of the European Ministerial Conference on the Environment;

iii. agreed, however, to reexamine this text in a most favourable spirit at the latest during their 306th meeting (June 1979 - A level) (2) if the European Community expresses before that date the wish to become a Contracting Party to the Convention, on the understanding that this reexamination shall deal exclusively with the modifications which will thus become necessary".

The Secretariat of the Council of Europe has sent to the Commission the amendments which must be made to the draft Convention so that it may be concluded by the Community.

This move clearly indicates the Council of Europe's interest in seeing the Community conclude the Convention.

(2) Scheduled date : 13 June 1979.

The amendments, set out in Annex II, correspond entirely to the negotiating guidelines which the Commission requested of the Council and thus constitute suitable basis for conclusion of the Convention by the Community.

The Commission accordingly takes the view that the Secretariat of the Council of Europe should be informed of this in good time, so that it can draw up the definitive text of the Convention for signature.. On the basis of this final text the Commission will recommend in the near future that the Council adopt a decision for .the conclusion of the Convention by the Community.    .

It is accordingly proposed that the Council :

- record its agreement on the amendments to be made to the Convention on the Conservation of European Wildlife and Natural Habitats,

- call on the Commission to request the Council of Europe, before 13 June 1979, to add these amendments to the text of the aforementioned Convention,

- approve the principle of conclusion by the Community of the Convention thus

- designate the persons empowered to sign the Convention thus amended.
